1. Agreement to Terms

By accessing or using the website of Techsist Labs (https://techsistlabs.com) or engaging our professional services (including Web Design, Custom Development, E-Commerce, UI/UX, SEO, Google Ads, Branding, or AI Solutions), you agree to be bound by these Terms & Conditions.

These terms apply to all clients, visitors, and users of our digital platforms and services. If you do not agree to these terms, please do not use our services.

2. Scope of Services & Proposals

All agency services provided by Techsist Labs are subject to individual proposals, statements of work (SOW), or written client agreements outlining deliverables, timelines, and milestones.

  • Project scope modifications requested by clients after project sign-off may incur additional fees.
  • Estimated timelines depend on prompt provision of required client assets, content, and feedback.

3. Intellectual Property Rights

Upon final settlement of project invoices, full ownership rights to custom visual designs, website copy, and custom-written code pass to the client, subject to the following conditions:

  • Pre-existing proprietary frameworks, open-source libraries, and third-party tools retain their respective licenses.
  • Techsist Labs reserves the right to showcase completed non-confidential project work in our agency portfolio unless restricted by a signed non-disclosure agreement (NDA).

4. Payment Terms & Invoicing

Payment schedules are agreed upon in writing prior to project kickoff (typically milestone-based or deposit followed by final delivery).

  • Invoices are due within the payment timeframe stated on the invoice (typically 7 to 14 days).
  • Delayed payments may pause active project work or delivery of final production files.

5. Limitation of Liability

Under Australian Consumer Law, our services come with guarantees that cannot be excluded. To the maximum extent permitted by law:

  • Techsist Labs shall not be liable for indirect, incidental, or consequential damages resulting from third-party server outages, search engine algorithm updates, or client-side content changes.
  • Our total liability under any project agreement is limited to the fees paid by the client for the specific service rendered.

6. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Australia. Any disputes arising in connection with these terms shall be subject to the jurisdiction of Australian courts.
